General
termsÊand conditions applicable unless superceded by individually
signed contracts between a client and Futurestep Consultancy
Ltd (hereafter referred to as the "Contractor")
1.
All contracts will state the purpose of any engagement
2. The work is to be performed by operatives supplied by the
Contractor
3. The Contractor has the unfettered right to substitute any
operative with another of similar or greater expertise.
4. The work undertaken must be completed by the deadlines
given by the Client.
5. The Contractor is responsible for training its operatives,
including the supply of all technical manuals, literature
necessary for them to acquire the specific skills to be able
to competently perform the various tasks required of them
by the Client.
6. The Contractor will supply computer equipment and software
to enable work to be carried out at locations other than those
of the Client, so that the work can proceed whilst access
to the Clients premises is not available.
7. The Contractor is not responsible for the supervision of
the Client's employees.
8. There is no period of notice for the termination of the
contract. The contract will terminate when the work is completed,
or at the end of the fixed term of the contract, or a breach
of the terms of the contract should occur.
9. Operatives of the Contractor must comply with the working
conditions of the Client as regards security, health and safety
etc.
10. There are no standard hours for the work during the contract.
11. There is no sick pay or holiday pay.
12. The Contractor may be required to keep the Client informed
of progress of any piece of work.
13. The Contractor may accept variations in the specification
of the work subject to any changes being re-quoted for and
then accepted by the Client.
14. There is no restriction to prevent the Contractor undertaking
other contracts during the period of this contract.
15. The Client has the option to extend the contract if both
parties are in agreement.
16. There is no intention between either party to create or
imply any mutuality of obligation between themselves either
i the course of, or between, any performance of services under
the scope of any specification or requirement.

Sales
Returns Policy
All new
goods will be covered with a one year return to base warranty,
both warranties are valid from date of invoice. All goods,
other than software, returned within the products warranty
period from date of invoice, with original receipt, are eligible
for repair or replacement. Futurestep Consultancy Ltd reserves
the right to replace or repair any faulty products or components
with either new or refurbished products dependent on requirements.
All Futurestep Consultancy Ltd warranties and technical support
will not cover any product, software or components that has
not been directly purchased from Futurestep Consultancy Ltd.
Any damage, fault or virus defecting the original Futurestep
Consultancy Ltd product occurring due to user modification,
including component and software implementation not supplied
by Futurestep Consultancy Ltd will not be covered by any Futurestep
Consultancy Ltd warranty and Futurestep Consultancy Ltd reserves
the right to charge for any labour, parts and delivery charges
incurred. Futurestep Consultancy Ltd telephone support will
only cover goods supplied by Futurestep Consultancy Ltd and
will not cover any enquiries relating to additional components
or software purchased elsewhere.
Return Material Authorisation Procedure
Before
returning any item you must call our Customer Service Department
on 0709-220-8193 within the warranty period of the goods purchased,
valid from the date of invoice, for a Return Material Authorization
(RMA) number and form. RMAs are valid for five days from date
of issuance. The completed RMA form must be included within
the packaging and the RMA number must appear on your return
packing label. Please do not write on the outside of the box.
Returns will not be accepted without an RMA. Any faults or
damage that is not documented on the Futurestep Consultancy
Ltd RMA form that may have occurred due goods in transit will
not be covered by the Futurestep Consultancy Ltd Warranty
documented above.
Ordering Information & Methods of Payment
U.K. customers
may pay for Cheque On Delivery (COD) with a personal or business
cheque that has been cleared by the TRANSAX Cheque Guarantee
System. All cheques must be faxed to Futurestep Consultancy
Ltd with a copy of the purchase order or sales order confirmation
prior to dispatch to ensure cheque clearance by the TRANSAX
system. Cheques may be subject to a maximum (2%) Transax surcharge
dependant on order value. Any cancelled or returned cheques
issued to Futurestep Consultancy Ltd will be subject to a
(10)% administration fee chargeable to the customer.
General Terms and Conditions
Prices,
specifications and availability of products are subject to
change without notice. Due to the volatile nature of the computer
market, descriptions may not reflect current technical information.
Any typographical, photographic, or specification error in
product, pricing or offers is subject to correction. Futurestep
Consultancy Ltd may change its pricing, product description
or specification after any order confirmation but prior to
dispatch of goods due to errors, changing market conditions,
product discontinuation or typographical errors. Monitors
and software are not included with computer systems unless
specified. We reserve the right to limits sales, including
the right to prohibit sales to re-sellers, business organisations
or individuals. Published prices do not include VAT delivery
charges and insurance. Proof of purchase and postage may be
required for refunds. To comply with certain reseller agreements
and government regulations, Futurestep Consultancy Ltd reserves
the right to refuse to export products from the United Kingdom
at any time. If you are purchasing products for export, you
are responsible for the necessary export documentation before
shipment is made to a foreign country. Manufacturer's warranties
for exported products may vary or be null and void. Futurestep
Consultancy Ltd may sell or share its customer information,
or any material, information, and ideas you provide. If you
prefer that your name not be sold or shared, please call us,
and we will exclude it.
Disclaimer of Warranty, Title to Goods, Trademarks
Futurestep
Consultancy Ltd hereby expressly disclaims all warranties
either expressed or implied including any implied warranty
of merchantability or fitness for a particular purpose. This
disclaimer in no way affects the term of any manufacturer's
warranty. The title to purchased goods is retained by Futurestep
Consultancy Ltd until goods are paid for by the purchaser
in full. Futurestep Consultancy Ltd reserves the right to
repossess any goods that have not been paid for in full and
invoice the customer for any legal, delivery and restocking
costs incurred. All trademarks published are the property
of their respective companies.
No Consequential Damages
In
no event shall Futurestep Consultancy Ltd, its subsidiaries
or affiliates, or their respective officers, directors, employees,
representatives or agents (collectively, "Futurestep Consultancy
Ltd") be liable for special, incidental, consequential, punitive,
indirect, or other special damages, including but not limited
to, loss of data, use, or profits, however caused, whether
for breach of contract, negligence, or otherwise, and whether
or not Futurestep Consultancy Ltd has been advised of the
possibility of any such damages. Futurestep Consultancy Ltd
may revise these terms and conditions at any time. These terms
and conditions are governed and construed by the laws (but
not the rules governing conflicts of law) of the U.K. You
agree that if any part of these terms and conditions are found
to be unenforceable, the remainder of these terms and conditions
will remain in full force and effect.
